ABOUT KPRA
What is the Kensington Park Residents’ Association (KPRA)?
The Kensington Park Residents’ Association (KPRA) represents property owners within Kensington Park and is responsible for managing and maintaining many of the shared facilities, landscaped areas and community assets throughout the neighbourhood.
Who is a member of KPRA?
Every property owner within Kensington Park is a member of KPRA. Membership is connected to ownership of the property and transfers to the new owner when a property is sold.
Is membership of KPRA compulsory?
Yes. Membership of KPRA forms part of owning property within Kensington Park and cannot be separated from the property.
What does KPRA manage?
KPRA oversees a range of shared assets and services across Kensington Park, including recreational facilities, common landscaping, selected roads and shared areas, security access systems and other neighbourhood services.
How is KPRA different from a Body Corporate?
KPRA applies across the wider Kensington Park neighbourhood. A Body Corporate applies specifically to properties within a particular unit title development and manages matters relating to that development and its common property. Some owners may therefore have responsibilities and levies to both KPRA and a Body Corporate.
Who manages KPRA on behalf of residents?
KPRA engages a professional property management company to assist with its day-to-day administration, levy management, resident enquiries, facilities and the management of shared assets and services.
Who governs KPRA?
KPRA is professionally managed by Boutique Body Corporate, who assist with the day-to-day administration of the Association, levy management, resident enquiries, facilities and the management of shared assets and services.
LEVIES, BUYING & SELLING
What are KPRA levies?
KPRA levies contribute towards the management, maintenance and operation of shared facilities, landscaped areas and other services provided across Kensington Park.
How are KPRA levies calculated?
Levies are set in accordance with the KPRA Constitution and approved budgets. The amount payable may vary depending on the property and applicable levy structure.
Are KPRA levies the same as Body Corporate levies?
No. KPRA levies relate to the wider Kensington Park neighbourhood. Owners of unit-title properties may also pay separate Body Corporate levies relating specifically to their building or development.
Can KPRA charge additional or special levies?
Yes. The KPRA Constitution provides for special or capital levies where additional expenditure is required outside the normal annual budget.
Is there a levy when I sell my Kensington Park property?
Yes. A Transfer Levy is generally payable when a Kensington Park property is sold. Under the current KPRA Constitution, this is calculated at 1%+ plus GST of the gross sale price, subject to applicable exemptions.
Are there exemptions from the Transfer Levy?
Yes. Certain transfers may qualify for an exemption under the KPRA Constitution, including some family, estate-planning and qualifying inter-Kensington Park transactions.
If I sell my Kensington Park home and buy another within the Park, do I pay the Transfer Levy?
A Transfer Levy exemption may apply where an owner sells and contemporaneously purchases a replacement property within Kensington Park, subject to the requirements of the KPRA Constitution.
What should I know about KPRA when buying at Kensington Park?
Ownership of a Kensington Park property includes membership of KPRA and an obligation to comply with its Constitution, Bylaws and applicable Design Controls. Your solicitor should review these documents with you before purchase.
What happens to KPRA membership when a property is sold?
KPRA membership is linked to property ownership. When ownership transfers, the purchaser becomes the KPRA member associated with that property.
Is anything required from KPRA before my property settles?
Yes. There are KPRA requirements associated with the transfer of ownership, including confirmation of levies and other amounts owing. Your solicitor should liaise with Boutique Body Corporate as part of the settlement process.
What information will my solicitor need when I sell?
Your solicitor may require information relating to KPRA levies, any outstanding amounts, the Transfer Levy and relevant ownership or membership documentation. Boutique Body Corporate can provide the appropriate information for settlement.
LIVING AT KENSINGTON PARK
Are pets allowed at Kensington Park?
Yes. Domestic pets are welcome at Kensington Park, subject to the KPRA Bylaws and any applicable Body Corporate rules. Owners are responsible for ensuring their pets do not cause a nuisance or disturbance to others.
Do dogs need to be on a lead?
Yes. Dogs must be kept on a lead when outside their owner’s property, and owners are responsible for cleaning up after their pets.
